Terms of Service & End User License Agreement
Please read this agreement before using Samtal. By downloading or using the App you confirm that you have read, understood, and accepted these terms in full.
1. Who We Are
Samtal ("the App") is provided by Ludwig Madsen Barbagallo, operating as Antfarm Studios, based in Denmark ("Developer", "we", "us"). Contact: ludwigmb@hotmail.com. This Agreement is between you ("User") and the Developer. It is not with Apple Inc. or any other platform distributor. Apple has no warranty or support obligations under this Agreement whatsoever.
2. License
Samtal is free of charge. The Developer grants you a personal, non-transferable, non-exclusive license to install and use Samtal on Macs you own or control. You may not resell, sublicense, reverse engineer, or redistribute the application.
The Developer is under no obligation to release future versions, updates, patches, or new builds of any kind. Whether further versions are ever produced is entirely up to the Developer. If future versions are released, you may use them at no cost.
3. Donations
The App is free; you may optionally support development with a donation via Ko-fi (ko-fi.com). Donations are voluntary gifts, are not payment for goods or services, do not create any entitlement to support, updates, or features, and are not refundable. Donation payments are processed by Ko-fi and its payment providers, which act as their own data controllers for the payment data you provide. We do not receive or store your card details.
4. How Samtal Works
Samtal is a local desktop application. It connects directly from your Mac to the messaging services you choose to log in to (WhatsApp, Telegram, Messenger, WeChat, iMessage, Apple Mail, and others) using your own credentials. We do not relay, store, intercept, or read your messages. They never reach our servers.
5. How This App Was Built — AI-Assisted Development
You acknowledge and understand that Samtal was developed with significant assistance from AI coding tools, specifically Anthropic's Claude Code. By using the App, you accept that:
- AI-generated code may contain bugs, unexpected behavior, or security vulnerabilities that the Developer may not be aware of
- There is a possibility, however unlikely, that AI-generated code could behave in unintended ways, including but not limited to unexpected data access or other anomalous behavior
- The Developer has made reasonable efforts to review the code but cannot guarantee its completeness or safety
- You are using the App with full knowledge of this development methodology and accept the associated risks
6. Third-Party Platforms
Samtal automates interaction with third-party services we do not control, including but not limited to WhatsApp, Messenger, iMessage, Apple Mail, Telegram, Instagram, X (Twitter), Reddit, Discord, LinkedIn, and Microsoft Teams. Your use of those services is governed by their own terms, and you are responsible for complying with them. We are not affiliated with, endorsed by, or sponsored by any of them. If any platform changes its interface, restricts access, or becomes unavailable, Samtal may stop working partially or entirely, and the Developer has no obligation to fix or update the application in response.
7. Data and Privacy
We do not operate accounts and do not collect or store personal data. There is no sign-up, no license server, and no analytics in the App. The App runs locally on your Mac.
What we do not collect. We do not collect, transmit, or have access to the contents of your messages, your contact lists, or your activity inside the App.
Donations. If you choose to donate, Ko-fi processes the payment and is the data controller for that data (see Section 3). We see only the donation metadata Ko-fi reports to us (amount, name/message if you provide one) — retained as required by Danish tax and accounting law (5 years).
Your rights under GDPR. For any personal data we do hold (e.g. support emails you send us, donation records), you have the right to access, correct, export, restrict processing of, or delete it, and to lodge a complaint with the Danish Data Protection Authority (Datatilsynet, datatilsynet.dk). Email the Developer at the contact address above; we will respond within 30 days. We do not sell, share, or use your data for advertising or profiling.
8. Service Availability
The App runs locally and works offline. The website and download hosting are provided on a best-effort basis with no uptime guarantee. We may modify, suspend, or discontinue them at any time.
9. Discontinuation
The App is free and does not depend on our servers to function. If we stop distributing Samtal, copies you have already installed keep working. We may, at our discretion, keep the final version available for download.
10. Forced Discontinuation Due to Legal Changes
If laws, regulations, court orders, or third-party platform policy changes make it unlawful or impractical to distribute or operate Samtal — in Denmark, the EU, or any jurisdiction we cannot reasonably exclude — the Developer reserves the right to immediately stop distribution, shut down the website, and delete the App and related infrastructure, without prior notice and without obligation to provide a replacement. The Developer is not liable for any consequences of such forced discontinuation, as these circumstances are outside the Developer's control.
11. Updates and Continued Development
We may release updates that fix bugs, add features, or adapt to changes in the underlying messaging platforms. We do not promise continued compatibility with any third-party platform whose terms or APIs change. The Developer makes no commitment to:
- Provide updates, bug fixes, or new features
- Respond to support requests, feedback, or bug reports within any particular timeframe or at all
- Continue developing or maintaining the application
Feedback and critique are welcomed but cannot be guaranteed a response.
12. No Warranty
Samtal is provided strictly "as is" and "as available." The Developer makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation, to the maximum extent permitted by law. You use this software entirely at your own risk.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any damages arising from your use of Samtal, including but not limited to:
- Data loss or corruption
- Damage to your device or system
- Loss of business, revenue, or profits
- Security incidents or unauthorized data access
- Account suspensions or bans on third-party messaging platforms
- Any consequences of the application becoming unavailable or non-functional
- Forced discontinuation of the App or service due to legal, regulatory, or third-party platform changes
As the App is provided free of charge, the Developer's total liability to you is zero to the maximum extent permitted by law. Nothing in this Agreement limits any liability that cannot be excluded under mandatory consumer-protection law.
14. Your Responsibility
You are responsible for maintaining backups of your data, for ensuring the application is appropriate for your use case, and for compliance with the terms of service of any third-party platforms you access through Samtal.
15. Termination
We may terminate your license if you breach these terms (for example, redistribution or reverse-engineering). You may stop using the App at any time.
16. Changes to These Terms
We may update these terms. Material changes will be posted on the website with a new "last updated" date and, where required by law, communicated by email. Continued use after a change means you accept the new terms.
17. Governing Law
This Agreement is governed by the laws of Denmark. Disputes are subject to the exclusive jurisdiction of the courts of Denmark, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
18. Acceptance
By downloading or continuing to use Samtal you confirm that you are at least 18 years old, that you have read and understood this Agreement, and that you accept its terms knowingly and voluntarily. Continued use after any update to these terms also constitutes acceptance of the updated version.
